Nyale Institute for Sexual and Reproductive Health Governance (Nyale Institute) has published a new an Issues Paper on the implementation implications of the AC (a Minor) judgment — a landmark court decision affirming the right of child survivors of sexual violence to access safe and lawful abortion in Malawi.
While the judgment clarified the law, significant gaps remain in how these rights are realised in practice.
The paper identifies key challenges in legal interpretation, policy guidance, and service delivery, and sets out practical recommendations to support effective implementation across institutions.
Key issues explored include:
• Legal grounds for abortion access
• Consent for minors
• Conscientious objection by providers
• Public awareness and misinformation
• Procedural and systemic barriers
The paper calls for coordinated action to ensure that this important legal development translates into real access to care and justice.
